Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of Seeden, an analytics platform operated by FOMO Labs Sdn Bhd (1473275-P) ("we", "us", "our"). By creating an account or using Seeden, you agree to these Terms in full.

2. Service Description

Seeden is a cloud-based analytics platform that allows businesses to upload sales data, visualise performance across outlets, and receive AI-generated insights and briefings. The platform is provided on a subscription basis (or free tier as described on the pricing page).

We reserve the right to modify, update, or discontinue features with reasonable notice. We will not materially degrade your plan's core functionality without notifying you in advance.

3. Account Terms

  • You must be at least 18 years old and legally capable of entering into a contract.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • One account per person or business entity. You may not share your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate and current information when registering.
  • We may suspend or terminate accounts found to be in violation of these Terms.

4. Acceptable Use

You agree not to:

  • Upload unlawfully obtained data or data you do not have the right to use.
  • Attempt to reverse-engineer, scrape, or exfiltrate the platform or its outputs.
  • Use Seeden to process or store sensitive personal data (e.g. IC numbers, health records) without our written consent.
  • Resell or sublicense access to the platform without our prior written approval.
  • Introduce malware, bots, or any code that could harm the platform or other users.

5. Payment Terms

Paid plans are billed monthly or annually in advance. All prices are in Malaysian Ringgit (RM) and inclusive of applicable taxes unless stated otherwise.

  • Payment is due at the start of each billing period.
  • Failed payments may result in temporary suspension of your account after a 7-day grace period.
  • We accept FPX, credit/debit cards, DuitNow, and major Malaysian e-wallets.
  • Prices may change with at least 30 days' advance notice. Founding 20 pricing is locked for 24 months as stated at time of purchase.

6. Cancellation & Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not provide pro-rated refunds for unused time within a billing period.

Exceptions may be made at our discretion for documented technical failures on our end. To request a refund, email hello@seeden.ai within 7 days of the charge.

Free accounts may be cancelled at any time with immediate effect. Data associated with a cancelled free account is deleted within 30 days.

7. Your Data & Intellectual Property

You retain full ownership of your business data. By uploading data to Seeden, you grant us a limited licence to process that data solely to provide the service to you. We do not claim ownership of your data.

Seeden's platform, UI, AI models, and proprietary algorithms are owned by FOMO Labs Sdn Bhd. Nothing in these Terms transfers intellectual property rights to you beyond the limited right to use the platform.

8. Uptime & Service Levels

We target 99.5% monthly uptime for paid plans. Planned maintenance will be communicated in advance. We are not liable for downtime caused by third-party infrastructure providers (e.g. Supabase, Cloudflare) or force majeure events.

9. Limitation of Liability

To the maximum extent permitted by Malaysian law:

  • Seeden is provided "as is" without warranty of any kind, express or implied.
  • We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including lost profits or data loss.
  • Our aggregate liability to you for any claim arising out of these Terms shall not exceed the amount you paid us in the 3 months immediately preceding the claim.

Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence.

10. Termination

We may suspend or terminate your account immediately and without notice if you breach these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the platform ceases immediately. We will retain your data for 30 days post-termination to allow for data export requests, after which it will be deleted.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users via email at least 14 days before material changes take effect. Continued use after that date constitutes acceptance of the updated Terms.
